Terms of Use for Zu-CityGames Website and Mobile Application

1. General Provisions

  1. These Terms and Conditions define the rules for using the Zu-CityGames.com website and the Zu-CityGames mobile application, as well as the conditions for purchasing and using digital services (city games).
  2. The seller and administrator of the service is: Marcin Chołodowski, conducting business registered in CEIDG, with headquarters at ul. Augustyna Szamarzewskiego 21 lok. 2, 61-514 Poznań , Tax ID (NIP): 7671640925, REGON: 385454553, e-mail: info@zu-citygames.com.

2. Definitions

  • Consumer – a natural person making a purchase not directly related to their business or professional activity.

  • Customer – any natural person or company making a purchase through the Zu-CityGames.com website.

  • Seller – the owner of Zu-CityGames service.

  • Product / Digital Service – access code for a city game available in the Zu-CityGames application.

  • Order – Customer’s declaration of intent to enter into a Product sales agreement.

  • Distance Contract – an agreement concluded via the Internet, without the simultaneous physical presence of the parties.

3. Contact

  1. Contact with the Seller is possible at: info@zu-citygames.com. We usually respond within 24 hours on business days.
  2. Before making a purchase, the Customer may contact the Seller for additional information.

4. Technical Requirements

  1. To use the services, the following are required:
  • a device with Internet access and a web browser,

  • current Android or iOS system (for the application),

  • active email address,

  • enabled cookies and GPS location services (for the application).

5. Orders and Payments

  1. Orders are placed through the form on Zu-CityGames.com.
  2. Payments are processed by Przelewy24 (PayPro S.A.) – payment by card, BLIK, or bank transfer is possible.
  3. After payment is confirmed, the access code for the game is automatically sent to the email address within 10 minutes.
  4. All prices shown on the website are gross prices (including VAT).

6. Service Delivery

  1. The access code enables one-time initiation of the selected city game in the Zu-CityGames application.
  2. The code is valid for 12 months from the date of purchase.
  3. The code can only be used once, on one device.
  4. We don’t require account creation or registration in the application.

7. Contract Withdrawal

  1. Placing an order for a digital game access code indicates explicit consent to begin service provision before the 14-day withdrawal period expires. The Consumer acknowledges that upon code activation, they lose the right to withdraw from the contract, in accordance with Article 38 point 13 of the Consumer Rights Act.
  2. If the code hasn’t been used, the Consumer may withdraw from the contract within 14 days of purchase by writing to: code@zu-citygames.com.
  3. Refund will be processed within 14 days of accepting the request, to the account used for payment.

8. Complaints

  1. The Customer has the right to file a complaint if:

    • the code doesn’t work,

    • there’s an application problem that prevents gameplay.

  2. Complaints should be sent to: info@zu-citygames.com.

  3. Complaints are processed within 14 days of receiving the report.

9. Application Usage Rules

  1. The Zu-CityGames application works only on mobile devices with Internet access and GPS location.

  2. The city game takes place in public spaces – participants are required to maintain safety rules and respect for the surroundings.

  3. The game is based solely on permanent city elements (e.g., buildings, plaques, monuments) – it doesn’t include any physical props.

  4. The application doesn’t store personal data – all gameplay data is processed locally on the player’s device.

  5. The Organizer reserves the right to temporarily disable selected games for organizational reasons (e.g., renovation work, access point closure).

  6. Unfavorable weather, lack of signal, or poor GPS quality do not constitute grounds for refund or complaint.

10. Copyright

  1. All content available in the Zu-CityGames application and on the Zu-CityGames.com website, including: scenarios, game descriptions, puzzles, texts, photos, graphic elements, and technical solutions, are protected under copyright law.

  2. Copying, sharing, duplicating, translating, publishing, or using the above materials in any form without prior written consent from the service owner is prohibited.

  3. Copyright infringement may result in civil and criminal liability under applicable law (particularly the Copyright and Related Rights Act).

11. Out-of-Court Dispute Resolution

  1. Consumers can use out-of-court dispute resolution methods, including:

    • mediation with the provincial Trade Inspection inspector,

    • permanent consumer arbitration court,

    • free consumer ombudsman assistance.

12. Personal Data Protection

  1. The Seller is the data controller. Data is processed in accordance with the Privacy Policy.
  2. Data provided during purchase (name, surname, email address, and residential or business address) is used solely for order fulfillment and VAT invoice issuance. Address data is required for tax purposes.

13. Terms Changes

  1. The Seller reserves the right to make changes to the terms for important reasons (e.g., changes in law, payment methods).

  2. Users will be notified of any changes at least 7 days in advance.

  3. The new terms do not affect orders placed before they take effect.

14. Final Provisions

  1. These Terms are effective from the date of publication on the website.
  2. In matters not regulated herein, Polish law applies, including:
    – Civil Code,
    – Act on Providing Services by Electronic Means,
    – Consumer Rights Act,
    – Personal Data Protection Act.
  3. Contracts are concluded in Polish. The order content and terms are stored in the Seller’s IT system for the period required by law.
