Terms and Conditions for the Purchase and Use of Zu-CityGames Digital Services

1. General Provisions

  1. These Terms and Conditions define the rules for using the Zu-CityGames.com website and the Zu-CityGames mobile application, as well as the terms governing the purchase and use of digital services (city games).

  2. The Seller and administrator of the service is: Marcin Chołodowski, conducting business activity registered in the Central Registration and Information on Business (CEIDG), with its registered office at: Augustyna Szamarzewskiego 21/2, 61-514 Poznań, Poland, Tax Identification Number (NIP): 7671640925, Business Registration Number (REGON): 385454553, E-mail: info@zu-citygames.com, Phone: +48 782 340 914.

2. Definitions

  • Consumer – a natural person making a purchase not directly related to their business or professional activity.

  • Customer – any natural person or company making a purchase through the Zu-CityGames.com website.

  • Seller – the owner of Zu-CityGames service.

  • Product / Digital Service – paid access to a selected city game, granted by means of an access code used within the Zu-CityGames mobile application.

  • Order – Customer’s declaration of intent to enter into a Product sales agreement.

  • Distance Contract – an agreement concluded via the Internet, without the simultaneous physical presence of the parties.

3. Contact

  1. Contact with the Seller is possible at: info@zu-citygames.com and phone:+48 782 340 914. We usually respond within 24 hours on business days.
  2. Before making a purchase, the Customer may contact the Seller for additional information.

4. Technical Requirements

  1. To use the services, the following are required:
  • a device with Internet access and a web browser,

  • current Android or iOS system (for the application),

  • active email address,

  • enabled cookies and GPS location services (for the application).

5. Orders and Payments

  1. Orders are placed via the order form available on the Zu-CityGames.com website.

  2. The purchase agreement is concluded when the Customer submits an Order by clicking the “Place order” button and the Seller receives confirmation of successful payment authorization from the payment service provider. Once payment has been confirmed, the Seller sends the access code for the purchased game to the e-mail address provided by the Customer.

  3. Electronic payments may be processed by:
    a) PayPro S.A., operating under the Przelewy24 brand.
    b) Autopay S.A.

  4. Available payment methods may include: BLIK, Pay by Link online bank transfers, Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro. The payment methods currently available are presented to the Customer during the checkout process.

  5. The payment gateway services provided through Autopay are operated by Autopay S.A.

  6. Order processing time is calculated from the moment the Seller receives confirmation of successful payment authorization from the payment operator.

  7. The access code is delivered electronically to the e-mail address provided during the ordering process immediately after payment confirmation, usually within a few minutes and no later than 10 minutes after payment has been confirmed. No physical product is shipped.

  8. All prices displayed on the website are gross prices, expressed in Polish złoty (PLN), and include applicable VAT. The purchase of an access code does not involve any shipping costs.

  9. Where a refund is due, the Seller shall reimburse the payment using the same payment method used by the Customer unless the Customer expressly agrees to another refund method that does not involve any additional costs.

6. Provision of the Digital Service

  1. The access code enables one-time initiation of the selected city game in the Zu-CityGames application.
  2. The code is valid for 12 months from the date of purchase.
  3. The code can only be used once, on one device.
  4. We don’t require account creation or registration in the application.

7. Right of Withdrawal

  1. The Consumer has the right to withdraw from a distance contract within 14 days from the date of its conclusion, subject to the exceptions provided for by applicable law.

  2. When placing an Order, the Consumer expressly agrees to the delivery of the access code before the expiry of the 14-day withdrawal period and acknowledges that, upon activating the access code and commencing the use of the digital service, the statutory right of withdrawal will be lost.

  3. Notwithstanding the above, the Seller voluntarily allows the Consumer to withdraw from the purchase agreement within 14 days from the date of purchase, provided that the access code has not yet been activated. A declaration of withdrawal should be sent to: code@zu-citygames.com.

  4. Once the access code has been activated, withdrawal from the agreement is no longer possible, except where mandatory provisions of applicable law provide otherwise. This does not affect the Customer’s right to submit a complaint where the digital service does not conform to the contract.

  5. Where the Consumer validly withdraws from the agreement, the Seller shall refund the payment no later than 14 days after receiving the withdrawal notice, using the same payment method used by the Consumer unless the Consumer expressly agrees to another refund method that does not involve any additional costs.

To withdraw from the agreement, the Consumer may use the model withdrawal form attached as Appendix No. 1 to these Terms and Conditions; however, the use of this form is not mandatory.

8. Complaints

  1. The Customer has the right to file a complaint if:

    • the code doesn’t work,

    • there’s an application problem that prevents gameplay.

  2. Complaints should be sent to: info@zu-citygames.com.

  3. Complaints will be examined within 14 days from the date of receipt. The complaint should include at least: the e-mail address used when placing the Order, the Order number (if available), a description of the problem.

9. Rules for Using the Application

  1. The Zu-CityGames application works only on mobile devices with Internet access and GPS location.

  2. The city game takes place in public spaces – participants are required to maintain safety rules and respect for the surroundings.

  3. The game is based solely on permanent city elements (e.g., buildings, plaques, monuments) – it doesn’t include any physical props.

  4. The application doesn’t store personal data – all gameplay data is processed locally on the player’s device.

  5. The Organizer reserves the right to temporarily disable selected games for organizational reasons (e.g., renovation work, access point closure).

  6. Unfavourable weather conditions, lack of mobile network coverage or poor GPS signal quality resulting from circumstances beyond the Seller’s control shall not, in themselves, constitute grounds for a complaint. This provision does not limit the Customer’s statutory rights in the event that the digital service does not conform to the contract.

10. Copyright

  1. All content available in the Zu-CityGames application and on the Zu-CityGames.com website, including: scenarios, game descriptions, puzzles, texts, photos, graphic elements, and technical solutions, are protected under copyright law.

  2. Copying, sharing, duplicating, translating, publishing, or using the above materials in any form without prior written consent from the service owner is prohibited.

  3. Copyright infringement may result in civil and criminal liability under applicable law (particularly the Copyright and Related Rights Act).

11. Alternative Dispute Resolution

  1. Consumers can use out-of-court dispute resolution methods, including:

    • mediation with the provincial Trade Inspection inspector,

    • permanent consumer arbitration court,

    • free consumer ombudsman assistance.

12. Personal Data Protection

  1. The Seller is the controller of the Customer’s personal data. Personal data is processed in accordance with the Privacy Policy.

  2. The data provided during the purchase process (first name, last name, e-mail address and, where applicable, VAT invoice details) is used solely for the purpose of processing the Order, communicating with the Customer and issuing a VAT invoice upon the Customer’s request.

13. Amendments to the Terms and Conditions

  1. The Seller reserves the right to make changes to the terms for important reasons (e.g., changes in law, payment methods).

  2. Users will be notified of any changes at least 7 days in advance.

  3. The new terms do not affect orders placed before they take effect.

14. Final Provisions

  1. These Terms are effective from the date of publication on the website.
  2. In matters not regulated herein, Polish law applies, including:
    – Civil Code,
    – Act on Providing Services by Electronic Means,
    – Consumer Rights Act,
    – Personal Data Protection Act.
  3. Contracts are concluded in Polish. The order content and terms are stored in the Seller’s IT system for the period required by law.
